Schedule 2 - Speed exemptions

In accordance with clause 4.2, the following table outlines those areas within the Waikato region, which have previously been granted speed exemptions under the Water Recreation Regulations 1979, and which have not been superseded by clauses in Schedule 1 of this bylaw.

NOTES:

  1. The regulations referred to in the table are quoted at the end of the table. It is these regulations which have been uplifted for the areas specified.
  2. For the purpose of clarification 7(1)a now has been replaced by 3.2.1a, 7(1)b has been replaced by 3.2.1b and 7(2) has no equivalent clause in this bylaw.

The following extracts from the Water Recreation Regulations 1979 are referenced in the above table:

Regulation 7 stated:

  1. Speed of small craft:
  2. No person shall propel or navigate a small craft at a proper speed exceeding 5 knots:
    1. within 30 metres of any other vessel, raft, or person in the water; or
    2. within 200 metres of the shore or of any structure; or
    3. within 200 metres of any vessel or raft that is flying Flag A of the International Code of Signals (diver’s flag).
  3. Every person who propels or navigates a small craft shall, as far as is practicable, do so at such a speed so that waves caused by the movement of the craft through the water do not break against the shore or against any structure.
  4. No person shall propel or navigate a small motor craft at a proper speed exceeding 5 knots while any person is sitting at or on the fore part or bow of that craft with any portion of his body extending over the fore part, bow, or side of that small craft.

Additional exemptions/ speed upliftings

S2.1 Lake Aratiatia S2.1.1 No person shall, without reasonable excuse, propel or navigate a vessel (including a vessel towing someone or some object) at a proper speed exceeding 5 knots:
  1. within 50 metres of any other vessel, raft or person in the water or any structure (excluding hydro dam structures); or
  2. within 30 metres of the edge of the water; or
  3. within 200 metres of any vessel or raft that is flying Flag A of the International Code of Signals (diver’s flag).

S2.1.2 Subclause 3.2.3 of this bylaw is suspended for the area.
S2.1.3 No person shall cause or allow himself or herself to be towed by a vessel (whether or not on a water ski, wakeboard, aquaplane, or other similar object) at a proper speed exceeding 5 knots in any circumstances specified in any of paragraphs (a) to (c) of subclause S2.1.1 above.
S2.2 Lake Atiamuri S2.2.1 No person shall, without reasonable excuse, propel or navigate a vessel (including a vessel towing someone or some object) at a proper speed exceeding 5 knots:
  1. within 50 metres of any other vessel, raft or person in the water or any structure (excluding hydro dam structures); or
  2. within 30 metres of the edge of the water; or
  3. within 200 metres of any vessel or raft that is flying Flag A of the International Code of Signals (diver’s flag).

S2.2.2 Subclause 3.2.3 of this bylaw is suspended for the area.
S2.2.3 No person shall cause or allow himself or herself to be towed by a vessel (whether or not on a water ski, wakeboard, aquaplane, or other similar object) at a proper speed exceeding 5 knots in any circumstances specified in any of paragraphs (a) to (c) of subclause S2.2.1 above.
S2.3 Lake Waipapa S2.3.1 No person shall, without reasonable excuse, propel or navigate a vessel (including a vessel towing someone or some object) at a proper speed exceeding 5 knots:
  1. within 50 metres of any other vessel, raft or person in the water or any structure (excluding hydro dam structures); or
  2. within 30 metres of the edge of the water; or
  3. within 200 metres of any vessel or raft that is flying Flag A of the International Code of Signals (diver’s flag).

S2.3.2 Subclause 3.2.3 of this bylaw is suspended for the area.
S2.3.3 No person shall cause or allow himself or herself to be towed by a vessel (whether or not on a water ski, wakeboard, aquaplane, or other similar object) at a proper speed exceeding 5 knots in any circumstances specified in any of paragraphs (a) to (c) of subclause S2.3.1 above.

Other exemptions or speed upliftings have been granted under previous editions of this bylaw, in accordance with subclause 4.2.4, for specific operators for defined periods of time.
